Mangocam Terms & Conditions

Your Use Of Mangocam's Services:

When a Mangocam user account is subscribed for, You will be required to nominate a password for Your account. You alone are responsible for the confidentiality and maintenance of Your password. You are solely responsible for this, and all use of Your account. This includes the security of Your password ensuring that this is not divulged to any third party, and it is Your acceptance to immediately notify Mangocam if any suspected unauthorised use of Your account.

It is agreed that as a user You shall not transmit, distribute or store any viruses or any other material during the course of Your use of the Mangocam Service that:

i) Is of a sexually explicit nature
ii) Is of a harmful or discriminatory nature
iii) Facilitates, supports or incites illegal activity or violence
iv) Causes damage or injury to another party or property

Should these stipulations be breached we unreservedly, without liability to the user have the right to disable Your account access to any material that breaches the above stipulated. Additionally You shall not attempt or action:

v) Any copies, modifications, additions, transmissions via any transmission vehicle any part of the software including the documentation
vi) Utilise the user services provided by Mangocam to either on-sell or provide gratis to a third party

User Account

When a user account is set up with Mangocam You accept a non-transferrable, non-exclusive license and the right to access the software and services as provided and authorised in these terms and conditions.

User rights are granted only to the title user and shall not be considered grated to the any subsidiary or holding company of the user.

Services

Mangocam shall make all reasonable business provisions to provide a service that is operable 24 hours a day, 7 days a week, we shall not however be held liable for any reason for interruptions to this service.

Customer Data

The user shall have and maintain at all times the sole right to their data. This includes the maintenance and integrity of such. Including any 'saves' / 'shares' / 'back ups' / 'disclosures' / 'deletions' / 'alterations'. We shall not be held liable for any alterations or loss of data as caused by third parties.

If any user data is processed in the setting up or maintenance of an account, the user remains the controller of this data content at all times. We shall assume the act of processing of data provided and the user shall be solely responsibility that the data provided is:

vii) Legally owned and allowed to be provided for processing
viii) If required third party consent covers any external data provided for processing
ix) And has been provided with appropriate measures to secure the data from accidental loss, damage or destruction or unconsensual third party access

Interference

Mangocam is not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with use of our service or any linked web site. You must take your own precautions to ensure that whatever you select for your use from the web site is free of errors, viruses or anything else (such as 'worms' or 'trojan horses') that may interfere with or damage the operations of your computer systems.

Indemnification

You agree to fully indemnify and hold Mangocam harmless from any claim, cost, demand or damage (including legal costs on a full indemnity basis) incurred or which may be incurred arising from a breach by you of these Terms and Conditions including the improper use of the web site by you or anyone who gains authorised or unauthorised access from you.

Governing Law

These Terms are governed by the laws of Victoria, Australia, and you agree to submit to the non-exclusive jurisdiction of its courts in relation to any matters concerning these Terms.

In adherence to such, Mangocam shall be indemnified in totality any breach of user obligations as listed.
